It’s now been made official what most of us already knew. On March 12th the borough assembly made it absolutely clear that sections 16, 17 and 18 of the Kodiak code draft revision are gone and dead! No resurrecting will be attempted! They are kaput! Once again, good job Kodiak and congratulations!

This victory over the Kodiak borough code revision is a perfect example of exactly how our Constitutional Republic was intended to function. A large group of frustrated, concerned and angry individuals came together in order to protect their Constitutional property rights and Freedom from a group of overzealous, arrogant and power greedy bureaucrats. There was no centralized control structure, no one single leader directing the people. It was truly an organic, grass roots movement spurred on by the realization that they stood to lose much of their personal Freedom along with most of their property rights. Like a pressure cooker that’s been under too much pressure for too long, it finally burst in an incredible display of individual passion as one person after another stood up and let years of bottled up frustration pour out of them! This amazing, overwhelming turnout indicates just how fundamental and sacred the idea of Freedom and property rights are in a free society!

This victory over the code revision gives reason to be optimistic about our future here in Kodiak. However, this optimism should be tempered with a few words of caution. As Thomas Jefferson said, “Eternal Vigilance is the price of Liberty!” The individual bureaucrats who wrote and attempted to implement this code will eventually go away but the usurping power and global control structure behind them will not! For this reason we can never again let our guard down and become complacent, indifferent and lazy as we did in the past, which nearly allowed these bureaucrats to ruin Kodiak.

The drip by drip loss of Freedom and property rights, also known as the totalitarian tip toe, has been happening for decades now. Its’ slow creep of tyranny known as administrative law (code) and political law (crony capitalism) are not only un-American, but are diametrically opposed to the founding Constitutional principles and ideals of this country. Our Founders knew quite clearly (because they had all lived through and fought a war caused by this very same usurpation of their Liberties via administrative law) that without property rights the people would be reduced to serfs, serving the whim of the ruling class. In our case the ruling class are the politicians and bureaucrats who write, implement and enforce these codes.

If you think the above is “radical”, keep reading. You ain’t seen nothin yet!

Ask a politician or bureaucrat if you collected money or provided services the same way they do would it be a crime? For example, if you owned a business and one of your customers stopped making purchases from you, could you legally charge that person a fine every day or every month until he finally decided to make that purchase from you? And if he decided he was never going to purchase from you again and would not pay your fine, could you legally seize his property? And if he decided he was not going to allow you to seize his property, could you point a gun at him and order him to leave his property, have him arrested and put him in a cage? And if he still would not leave and he grabbed a gun to defend himself against your gun, could you legally shoot and kill him?

What is described above is, in general, the sequence of events that would and do occur, all the time, when an individual does not bow down to administrative law. “But administrative law (aka code) works, so it must be a good thing, right?” Rape works to get a women pregnant but does that mean it’s a good way to start a family? Administrative law is nothing more than an arrogant bureaucrats opinion backed by threat of force, the threat of taking your money by force (aka stealing) and/or the threat of pointing a gun at you and putting you in a cage!

But we live in modern times. Things are much more complicated today than one or two hundred years ago. Right? Therefore we need more laws, rules, code, etc, to deal with this modern complexity, right?” It is true, “modern times” (2015) are much more complicated than past generations. But what if we are getting cause and effect mixed up? Meaning, perhaps the reason the times we live in are more complex is not because “modern times” are innately or inherently more complex or that complexity is a by product or some kind of default setting of “modern times”, maybe the complexity of our “modern times” is due exclusively to the millions upon millions of laws, regulations, ordinances, rules, codes, treaties, covenants, etc, at every level of government, intruding into every conceivable aspect of our lives that we, in “modern times”, must deal with every day! And in which our ancestor did not have to deal with at all! Let’s take a look at just one thing; the US tax code. The average tax payer spends 15 to 20 hours per year preparing their taxes and businesses easily spend double or triple that time! (I tried to figure out what the average taxpayer pays in taxes every year, however, due to the complexity of the 70,000 plus page tax code, that is an near impossible task)! One hundred years ago people did not pay an income tax! If our great great grandparents could see all the hours we spend and waste preparing our taxes and all the hours we spend working just to pay those taxes, to them it would seem as if the world had gone insane! They would see us as nothing more than farm animals or slaves, which is more or less what we have become! And this is just one example of thousands upon thousands of these “little tyrannies” we deal with every day in “modern times” that could not have even been imagined one hundred years ago. If our Founders came back today, they would no doubt lose their mind, wondering in horror, how things could have gone so incredibly wrong!

I realize these are pretty “radical” ideas for most people. However, not too long ago in this country these ideas were the norm rather than the exception! They were not considered radical or extreme. Most people understood the Constitution because they learned about it in school. People knew that the Bill of Rights were not rights given to them by government but were given to them by their creator! However, starting about 100 years ago, the ideas of Natural Law, limited government, individual responsibility, free markets, individual Liberty and Freedom that our Constitutional Republic once stood for and which most people regarded as sacred, fell out of favor for ideas like “the good of the community”, “fairness and equality”, “social justice”, “national security”, “values clarification”, “cultural diversity”, “sustainable development”, “no child left behind”, “the war on poverty”, “Common Core”, “the Patriot Act”, “NDAA”, “the war on drugs”, “tolerance and diversity”, “the war on terror”, etc, all being implemented under the ideas of the ends justify the means and the common good! The most heinous and violent acts ever committed, the greatest mass murders, the most horrific acts of torture, displacement of human beings, theft of private property, etc., have been committed by government against its’ own citizens since time immemorial, by the ideas of the ends justify the means and the common good! How did this gradual but massive transformation in our thought processes occur? To learn the answer read the article linked at the top of entitled, “Agenda 21-Part 1”.
As Dresden James said, “When a well-packaged web of lies has been sold gradually to the masses over generations, the truth will seem utterly preposterous and its speaker a raving lunatic.”

In ending, human interaction should be voluntary. The initiation of force is wrong regardless whether it’s private, corporate or government initiating the force! This goes for local government implementing and enforcing local code all the way up to our military conducting “preemptive” war (pre-crime) against other nations. The only time force is justified is in self defense! There absolutely is no other justification for it!

NOTE: If there are some people reading this and wondering how all this talk of Freedom, the Bill of Rights, Liberty, the Constitution, property rights, our Founders, etc, square with the white mans usurpation of Native American land and freedom, please continue reading. There is no excuse for the horrors directed towards the Natives of North America by the white man. Even with documents as great as the US Constitution and Bill of Rights, if wielded by greedy, ruthless, dishonest men, the results can and will be enslavement! Our federal legislature at the time, greedy for Manifest Destiny, showed contempt for the Constitution and a racist, ruling class, elitist attitude toward the Indians by declaring them only half human, thereby denying them Constitutional rights. To paraphrase John Adams “Our Constitution was made only for a moral people. It is inadequate to the government of any other”. Some people say that since “we did it to the Indians than we deserve it done back to us!” It is ludicrous and absurd to deny a group of people their Constitutional protection today, simply because a group of men 200 years ago denied Constitutional protection to a group of people then. The late, great Native American Russell Means (, hero and champion of Freedom and the U.S. Constitution has this to say “Americans have lost the ability of critical thought, and with each successive generation become more irresponsible and as a consequence less free, disregarding a near-perfect document, the Constitution, which was derived from Indian law.”
